Foundation Wizard is developed and published by Michael Bonnell / Bonnell Apps.

These Terms of Use govern your use of the Foundation Wizard mobile application, website, reports, and related support. By using Foundation Wizard, you agree to these Terms. If you do not agree, do not use the app or website.

1. The service

Foundation Wizard is a field-reference calculation and communication tool. It can help users organize inputs, calculate elevations and concrete quantities, save local job information, and create reports for review or sharing.

Foundation Wizard is developed and published by Michael Bonnell / Bonnell Apps. References to Foundation Wizard, we, us, or our in these Terms refer to Michael Bonnell / Bonnell Apps as the app's developer and publisher.

2. Platform availability

The free and unlocked iOS update includes all current features without a subscription, trial, or in-app purchase. Android is available now as a free, fully unlocked download.

Earlier iOS versions offered Foundation Wizard Plus through Apple. Once Plus is removed from sale, no new sign-ups or renewals are offered. Apple continues to control historical transaction records and refund requests.

3. License and permitted use

Subject to these Terms and applicable store rules, we grant you a limited, personal, revocable, non-exclusive, non-transferable license to use Foundation Wizard on devices you own or control for lawful field-reference and communication purposes.

You may not copy, resell, sublicense, reverse engineer, defeat access controls, distribute modified versions, interfere with operation, use the app unlawfully, or use Foundation Wizard to mislead another person, except where applicable law expressly permits an activity that cannot be restricted by contract.

4. Your inputs and responsibilities

Foundation Wizard's output depends on the information you enter. You are responsible for accurate inputs, correct units and calculator mode, appropriate assumptions, names and labels, and complete review of every result and report before use.

You must independently verify calculations, conversions, dimensions, elevations, raise or lower values, quantities, rounding, and shared report content using appropriate project documents, methods, and qualified personnel. You are also responsible for jobsite safety, legal and regulatory compliance, employer and client requirements, and permission to store or share job information.

5. No surveying, engineering, or professional service

Foundation Wizard is not a surveying instrument, survey record, engineering tool, design system, construction-management service, safety system, or professional certification. It does not provide surveying, engineering, architectural, legal, safety, accounting, or other professional advice.

Do not use Foundation Wizard as the sole source of truth for survey control, structural design, engineering certification, legal compliance, energized work, excavation, rigging, lifting, utility clearance, concrete acceptance, payment certification, regulatory submission, or any other hazardous, life-safety, or high-consequence decision. Consult qualified professionals and controlling project documents where appropriate.

6. Estimates, units, and field conditions

Concrete and material quantities are estimates based on user-entered measurements and assumptions. Actual needs may differ because of excavation conditions, overdig, irregular shapes, sloughing, waste, subgrade, settlement, formwork, displacement, embeds, weather, placement practices, measurement error, specifications, or other field conditions.

Unit selection, conversion, and rounding can materially affect a result. Confirm the applicable measurement system, tolerances, overage, and ordering requirements before relying on or communicating a quantity.

7. Local storage and data loss

Foundation Wizard stores jobs and preferences locally and does not provide a Foundation Wizard cloud account, synchronization service, permanent archive, engineering database, or official records system.

The Android app is configured to exclude its app data from Android cloud backup and device-to-device transfer. Data may be permanently lost if you delete the app, clear storage, replace or lose a device, experience corruption or failure, or if an operating-system action or software update affects storage. You are responsible for preserving required records in an appropriate system outside Foundation Wizard.

8. Copy, export, and share

Foundation Wizard may let you copy, export, or share reports through other apps and services. Review the complete report and intended recipient before sending it. Once information leaves Foundation Wizard, we do not control its delivery, storage, modification, forwarding, security, interpretation, or use.

You represent that you have the right to use and share the information you enter. You remain responsible for confidential, proprietary, employer, client, project, and personal information and for the consequences of sharing it.

9. Intellectual property and feedback

Foundation Wizard's software, user interface, branding, text, graphics, report formats, and related materials are owned by Michael Bonnell / Bonnell Apps or their licensors and are protected by applicable intellectual-property laws.

If you voluntarily send feedback, ideas, suggestions, screenshots, or bug reports, you grant us permission to use that material without restriction or compensation to operate, support, and improve Foundation Wizard. Do not send material you are not authorized to provide.

10. Updates, availability, and support

We may add, change, reorganize, or discontinue features; issue bug, security, compatibility, or legal updates; or stop supporting a platform or app version. We do not promise continuous availability, compatibility with every device, or preservation of any particular feature.

Support may be offered by email at our discretion and is not guaranteed to be immediate or continuously available. Beta or test versions may be incomplete and should not be used for critical work.

11. Disclaimer of warranties

To the fullest extent permitted by law, Foundation Wizard and the website are provided as is and as available, without warranties of accuracy, completeness, reliability, availability, merchantability, fitness for a particular purpose, non-infringement, error-free operation, or suitability for a particular job or result.

We do not warrant that calculations, conversions, reports, stored data, sharing, or platform services will be uninterrupted, recoverable, current, or free of defects. Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

12. Limitation of liability

To the fullest extent permitted by law, Michael Bonnell, Bonnell Apps, Foundation Wizard, and their service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, profits, revenue, business, opportunity, goodwill, or project time arising from the app, website, reports, calculations, sharing, or inability to use them.

To the fullest extent permitted by law, total liability for all claims related to Foundation Wizard will not exceed the greater of ten U.S. dollars or the amount you paid for Foundation Wizard through the applicable app store during the twelve months before the event giving rise to the claim. Applicable law may give you rights that cannot be waived or limited; those rights remain unaffected.

13. Third-party and app-store terms

Apple, Google, device operating systems, email providers, messaging services, and other third parties operate under their own terms and privacy practices. Your use of an app-store version is also subject to the applicable store's rules. Foundation Wizard is not responsible for third-party services or their availability, decisions, or conduct.

14. Termination

You may stop using Foundation Wizard at any time. We may restrict support or access to related services if you violate these Terms, misuse the product, create security or legal risk, or where required by law. Uninstalling the iOS app does not cancel an Apple subscription; cancellation must be completed through Apple.

15. Governing law and disputes

These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict-of-law principles, except where applicable law requires otherwise. Before filing a formal claim, contact mike@foundationwizard.io and give us a reasonable opportunity to resolve the matter informally. Any court proceeding must be brought in a court with proper jurisdiction and venue, subject to rights that applicable law does not allow these Terms to restrict.

16. General terms

If a provision is found unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a business reorganization or transfer. These Terms and the Privacy Policy are the entire agreement concerning your use of Foundation Wizard, subject to mandatory app-store terms and applicable law.

We may update these Terms when the product, platform requirements, law, or our practices change. The effective date identifies the current version. Continued use after updated Terms take effect constitutes acceptance where permitted by law.
