TERMS OF USE

These Terms of Use (“Terms”) govern your access to and use of the Foundation Wizard mobile application, website, subscription features, saved job features, copy/share features, reports, calculations, and related services (“Foundation Wizard,” the “App,” “Service,” “we,” “our,” or “us”).



By downloading, accessing, or using Foundation Wizard, you agree to these Terms. If you do not agree, do not use Foundation Wizard.



Foundation Wizard is a field reference and communication tool. It is not a substitute for licensed surveying, licensed engineering, professional judgment, project specifications, contract documents, site-specific requirements, applicable laws, codes, standards, or independent verification.



1. PURPOSE OF FOUNDATION WIZARD



Foundation Wizard is intended to help users perform and organize field-related calculations and job communication, including but not limited to:



Elevation calculations

Raise/lower results

Yardage calculations

Concrete volume calculations

Point and structure naming

Saved job summaries

Clean copy/share reports

Combined elevation and yardage summaries

Field communication with crews, contractors, supervisors, clients, third parties, or other recipients



Foundation Wizard is designed for convenience, field reference, and communication assistance only.



2. FIELD REFERENCE ONLY



All results generated by Foundation Wizard are for field reference only.



You are responsible for independently verifying all information before using it, relying on it, sharing it, ordering material, directing work, performing work, approving work, or making decisions based on it.



Foundation Wizard does not replace:



Licensed surveyors

Licensed engineers

Professional judgment

Project specifications

Contract documents

Site plans

Construction drawings

Approved submittals

Manufacturer requirements

Employer procedures

Safety rules

Applicable laws, codes, or standards

Independent field verification



Use Foundation Wizard at your own risk.



3. USER RESPONSIBILITY



You are solely responsible for:



Entering accurate information

Selecting the correct units

Selecting the correct calculator mode

Entering correct elevations

Entering correct dimensions

Entering correct yardage information

Naming points, structures, or jobs correctly

Reviewing all results before use

Reviewing all saved jobs before relying on them

Reviewing all copied or shared reports before sending them

Confirming that the information is suitable for the intended purpose

Confirming that you have permission to share any job-related information

Complying with all jobsite, employer, client, legal, regulatory, safety, survey, engineering, and construction requirements



Incorrect inputs may produce incorrect outputs.



Foundation Wizard does not guarantee that any result, report, saved job, shared summary, copied text, calculation, conversion, or displayed value is accurate, complete, current, suitable, or error-free.



4. NO PROFESSIONAL ADVICE



Foundation Wizard does not provide engineering advice, surveying advice, construction management advice, legal advice, safety advice, accounting advice, tax advice, or professional consulting services.



Any calculations, reports, examples, disclaimers, labels, wording, or guidance inside Foundation Wizard are general field-reference aids only.



You should consult qualified professionals where appropriate.



5. NOT FOR HIGH-RISK USE



Foundation Wizard should not be used as the sole source of truth for critical, hazardous, safety-sensitive, structural, engineering, legal, financial, or life-safety decisions.



Do not use Foundation Wizard as the only basis for:



Structural design

Survey control

Engineering certification

Legal compliance

Safety-critical work

Utility clearance decisions

Energized electrical work decisions

Load-bearing decisions

Rigging decisions

Crane or lifting decisions

Excavation safety decisions

Concrete acceptance decisions

Payment certification

Contract claims

Regulatory submissions

Any decision where error could cause injury, death, property damage, financial loss, legal exposure, or project failure



6. CORE CALCULATOR FEATURES



Foundation Wizard may provide free core calculator features, including elevation and yardage calculation tools.



We intend for core calculator use to remain available without requiring a Foundation Wizard Plus subscription.



However, we may update, modify, improve, remove, reorganize, limit, or change features over time to improve the app, fix bugs, comply with Apple requirements, address technical issues, or support the Service.



7. FOUNDATION WIZARD PLUS



Foundation Wizard may offer an optional paid subscription called Foundation Wizard Plus.



Foundation Wizard Plus may unlock convenience and professional communication features, including but not limited to:



Save Job

Copy clean reports

Share job summaries

Combined elevation and yardage report sharing

Future export or reporting features



Foundation Wizard Plus does not change the requirement that all calculations and reports must be independently verified.



8. APPLE APP STORE PURCHASES AND SUBSCRIPTIONS



Foundation Wizard Plus purchases and subscriptions are handled through Apple’s App Store systems.



Apple manages:



Payment processing

Billing

Subscription renewals

Free trials

Cancellations

Refunds

Subscription settings

Apple ID account billing

Family sharing eligibility, if applicable

Sandbox/TestFlight testing behavior, if applicable



We do not receive your full credit card number or full payment credentials from Apple.



Subscription terms, pricing, free trial availability, renewal details, and cancellation options are displayed through Apple’s App Store purchase and subscription systems.



You can manage or cancel subscriptions through your Apple ID subscription settings.



9. FREE TRIALS



Foundation Wizard Plus may include a free trial.



If a free trial is offered, the specific trial terms will be shown through Apple’s App Store purchase interface.



Unless cancelled before the end of the trial period, Apple may automatically renew the subscription and charge your Apple ID according to the terms shown during purchase.



Trial eligibility is determined by Apple.



10. SUBSCRIPTION CHANGES



We may change subscription pricing, included Plus features, free trial terms, or available plans in the future.



Any subscription changes will be handled according to Apple’s App Store rules and applicable law.



Some changes may apply only to new subscribers. Other changes may require user consent through Apple.



11. REFUNDS



Refunds for App Store purchases and subscriptions are handled by Apple.



If you want to request a refund, you must use Apple’s refund process.



We do not control Apple’s refund decisions.



12. SAVED JOBS



Foundation Wizard Plus may allow you to save jobs or job summaries.



Saved jobs may include information such as:



Job names

Point names

Structure names

Elevation values

Raise/lower results

Yardage values

Dimensions

Concrete volume calculations

Combined elevation and yardage summaries

Generated report text



Saved jobs are intended for convenience and field communication only.



Foundation Wizard is not intended to be a permanent archive, official record system, engineering database, survey record system, legal project record, or cloud backup service.



Unless a future cloud/account feature is clearly introduced, saved jobs are intended to be stored locally on your device.



You are responsible for preserving any information you need outside the app.



13. LOCAL STORAGE AND DATA LOSS



Foundation Wizard may store app data locally on your device.



Local app data may be lost if:



You delete the app

You clear app data

Your device is lost or damaged

Your device is replaced

Your device is reset

Your operating system removes local data

Your local storage becomes corrupted

A software update changes app storage behavior

A bug occurs

You manually clear or overwrite information



We are not responsible for lost app data, lost saved jobs, lost reports, lost copied text, lost shared messages, or lost project information.



14. COPY AND SHARE FEATURES



Foundation Wizard Plus may allow you to copy or share reports, job summaries, elevation results, yardage results, combined reports, or other information.



When you copy or share information, you are responsible for reviewing it before sending or relying on it.



Once information leaves Foundation Wizard, we do not control how it is stored, transmitted, received, modified, forwarded, copied, saved, used, or interpreted.



Third-party apps, messaging services, email services, employers, clients, contractors, crew members, supervisors, inspectors, batch plants, or other recipients may handle shared information according to their own systems and policies.



You are responsible for making sure you have permission to share any job-related, project-related, employer-related, client-related, confidential, proprietary, or sensitive information.



15. REPORTS AND COMMUNICATION



Foundation Wizard may generate clean report text for communication.



Reports are only as accurate as the information entered by the user.



Generated reports may include:



Job names

Structure names

Point names

Elevation results

Raise/lower values

Yardage totals

Concrete volume calculations

Dimensions

Measurement units

Disclaimers

Foundation Wizard branding

Website or support contact information



You are responsible for checking all report content before sending it.



16. THIRD-PARTY RECIPIENTS



If you share Foundation Wizard reports with third parties, including crew members, employers, contractors, clients, inspectors, batch plants, or other recipients, you are solely responsible for the consequences of that sharing.



Foundation Wizard is not responsible for:



Misunderstood reports

Incorrectly entered information

Incorrectly shared information

Recipient misuse

Recipient reliance

Forwarded reports

Changed reports

Lost messages

Delayed messages

Failed delivery

Incorrect recipients

Unauthorized sharing

Project disputes

Material ordering errors

Batch plant errors

Crew errors

Supervisor errors

Contractor errors

Client errors



17. MEASUREMENT UNITS AND CONVERSIONS



Foundation Wizard may support different measurement systems, including U.S. survey feet, international feet, meters, feet and inches, decimal feet, yardage, cubic yards, and related units or conversions.



You are responsible for confirming the correct units are selected and used.



Unit selection errors can produce incorrect results.



Conversions and displayed values should be independently verified before use.



18. ROUNDING AND DISPLAYED VALUES



Foundation Wizard may round or format displayed values for readability.



Internal calculations and displayed outputs may differ based on rounding, formatting, device display, unit selection, or future app updates.



You are responsible for verifying whether rounded or displayed values are appropriate for your use.



19. CONCRETE YARDAGE AND MATERIAL ESTIMATES



Yardage calculations are estimates based on user-entered dimensions and assumptions.



Foundation Wizard does not guarantee actual required concrete quantity.



Actual concrete needs may vary based on:



Excavation conditions

Overdig

Formwork

Subgrade conditions

Irregular shapes

Sloughing

Waste

Settlement

Measurement error

Jobsite conditions

Rebar, conduit, duct banks, embeds, or displacement

Batch plant practices

Crew practices

Project specifications

Required overage

Weather

Material behavior

Other field conditions



You are responsible for independently verifying quantities before ordering or placing material.



20. OVERAGE AND DISPLACEMENT FEATURES



If Foundation Wizard includes overage, trench, conduit, duct bank, displacement, or similar features, those tools are estimates for planning and communication only.



They are not engineering calculations.



You are responsible for determining whether any overage, displacement, or quantity adjustment is appropriate for the job.



21. NO WARRANTY



Foundation Wizard is provided “as is” and “as available.”



To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to:



Accuracy

Reliability

Completeness

Fitness for a particular purpose

Merchantability

Non-infringement

Availability

Error-free operation

Uninterrupted operation

Compatibility with your device

Suitability for any job, project, trade, use, or purpose



We do not guarantee that Foundation Wizard will always function without bugs, errors, interruptions, calculation issues, display issues, subscription issues, storage issues, device issues, or compatibility problems.



22. LIMITATION OF LIABILITY



To the fullest extent permitted by law, Foundation Wizard, its owner, developer, operator, affiliates, service providers, and related parties shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, punitive, or similar damages, including but not limited to:



Incorrect calculations

Incorrect measurements

Incorrect reports

Incorrect shared information

Lost data

Lost saved jobs

Lost profits

Lost revenue

Business interruption

Project delays

Material ordering errors

Concrete quantity errors

Rework

Construction defects

Safety incidents

Property damage

Personal injury

Legal claims

Contract disputes

Professional liability

Employer or client disputes

Loss of goodwill

Device issues

Subscription issues

App Store issues

Third-party service issues



This limitation applies whether the claim is based on contract, tort, negligence, strict liability, warranty, statute, or any other legal theory, even if we were advised of the possibility of such damages.



23. MAXIMUM LIABILITY



To the fullest extent permitted by law, if we are found liable for any claim related to Foundation Wizard, the maximum total liability shall not exceed the amount you paid for Foundation Wizard Plus during the three months before the claim arose, or ten U.S. dollars, whichever is greater.



Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.



24. USER CONDUCT



You agree not to:



Use Foundation Wizard for unlawful purposes

Use Foundation Wizard in a way that violates safety rules, laws, regulations, contracts, employer policies, or project requirements

Use Foundation Wizard as the sole source of truth for critical work

Reverse engineer, copy, modify, resell, or redistribute the app except as allowed by law

Interfere with the app’s operation

Attempt to bypass subscription controls

Use the app to store or share information you do not have permission to use

Use the app to mislead others

Upload, send, or share harmful, unlawful, confidential, or unauthorized information through support communications or related services



25. INTELLECTUAL PROPERTY



Foundation Wizard, including its name, design, layout, branding, text, icons, user interface, calculations, reports, software, code, graphics, and related materials, is owned by Foundation Wizard or its owner/developer, except where third-party materials or platform components are used.



You may use Foundation Wizard only as permitted by these Terms and applicable App Store rules.



You may not copy, reproduce, distribute, sell, sublicense, modify, reverse engineer, or create derivative works from Foundation Wizard except as allowed by law.



26. FEEDBACK AND SUGGESTIONS



If you send us feedback, ideas, suggestions, bug reports, feature requests, screenshots, or other comments, you grant us permission to use them without restriction or compensation.



We may use feedback to improve Foundation Wizard, create new features, change existing features, fix bugs, update documentation, or support future products.



27. APP UPDATES



We may update Foundation Wizard from time to time.



Updates may include:



Bug fixes

Design changes

Feature changes

Subscription changes

Security changes

Compatibility changes

Performance improvements

App Store compliance changes

Legal or disclaimer updates



Some updates may be required for continued use.



We are not obligated to provide any particular feature forever.



28. FEATURE AVAILABILITY



Some features may not be available at all times or on all devices.



Feature availability may depend on:



Device type

Operating system version

App version

Apple App Store availability

Subscription status

Network access

Apple StoreKit behavior

Region or country

Technical limitations

Testing status

Future app updates



29. APP STORE TERMS



Your use of Foundation Wizard may also be governed by Apple’s App Store terms, Apple Media Services Terms and Conditions, Apple subscription rules, Apple payment systems, and device operating system rules.



If there is a conflict between these Terms and Apple’s required terms, Apple’s terms may control where applicable.



30. TESTFLIGHT AND BETA TESTING



If you use Foundation Wizard through TestFlight or another beta testing method, you understand that the app may be unfinished, experimental, unstable, or subject to change.



Beta versions may contain bugs, incomplete features, placeholder text, subscription testing limitations, or other issues.



Do not rely on beta versions for critical work.



31. WEBSITE USE



The Foundation Wizard website may provide information, privacy policy, terms of use, support contact information, app descriptions, links, and related materials.



Website content is provided for general information only.



We do not guarantee that the website will always be available, error-free, current, or complete.



32. SUPPORT



We may provide support by email or other methods at our discretion.



Support is not guaranteed and may not be available at all times.



We may choose not to respond to messages that are abusive, unlawful, unrelated, spam, threatening, or inappropriate.



Support communications may be retained as described in the Privacy Policy.



33. PRIVACY



Your use of Foundation Wizard is also governed by our Privacy Policy.



The Privacy Policy explains how information may be handled when you use the app, website, support email, subscription features, saved job features, and copy/share features.



34. TERMINATION



We may suspend, restrict, or terminate access to Foundation Wizard or related services if we believe you have violated these Terms, misused the app, attempted to bypass subscription controls, violated applicable law, or created risk for us, users, the app, or related systems.



You may stop using Foundation Wizard at any time.



Deleting the app does not automatically cancel an Apple subscription. You must cancel subscriptions through your Apple ID subscription settings.



35. CHANGES TO THESE TERMS



We may update these Terms from time to time.



Updates may reflect changes to the app, subscriptions, saved job features, copy/share features, legal requirements, App Store requirements, business practices, or other reasons.



When these Terms are updated, the effective date will be updated.



Your continued use of Foundation Wizard after updated Terms are posted means you accept the updated Terms.



36. GOVERNING LAW



These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict of law principles, unless applicable law requires otherwise.



37. DISPUTES



Before bringing a formal claim, you agree to contact us first and attempt to resolve the issue informally.

Any dispute related to Foundation Wizard shall be handled in a court of competent jurisdiction, unless applicable law requires a different process or location.



38. SEVERABILITY



If any part of these Terms is found invalid, unlawful, or unenforceable, the remaining parts will remain in effect.



39. NO WAIVER



If we do not enforce a part of these Terms, that does not mean we waive the right to enforce it later.



40. ENTIRE AGREEMENT



These Terms, together with the Privacy Policy and any applicable Apple App Store terms, form the agreement between you and Foundation Wizard regarding use of the app, website, subscription features, saved job features, copy/share features, and related services.
